I recently pulled a car over for speeding. Nothing major, and had full intentions of just writing a written warning. As I approached the car the driver gets REAL nervous. Not the usual nervous I get rom most folks.

I ask him for his license and registration and he is shaking like he is having a seizure. I ask him to step out of the car and I proceed to pat him down for weapons. (Not a frisk through his pockets, but rather just a pat down to feel for a gun, knife or rocket launcher :harhar: ) He is still extremely nervous and now my back up has arrived. I ask the passenger to step out and ask him if he has anything he shouldn't and he says no. I then pat him down and feel something in his front right pocket. I ask what it is and he tells me "rolling papers." I ask what he uses them for and here is what I got. "I use them to patch my cigarettes up if they break." I almost whizzed down my leg as I couldn't believe what he said. I politely shook his hand as that is normal for me when someone gives me an excuse I haven't heard.

Anyway, I have the drivers license and ask him for consent to search. He says he doesn't care. What I always ask is, "has anyone left anything in your car that you do not know about." Kinda like the airport folks that ask you if anyone packed your bag like you are a member of the Royal Family or something. Anywho he tells me that no one else besides his friend was in there and that he cleaned his car earlier in the day. I begin my search and find about 1/2 ounce of marijuana in the console. We then detain the subjects as neither of them take responsibility for the weed.

Take them both to the PD and process them for simple possession of Schedule 6 (marijuana). I again ask the driver if the marijuana was his and he said he didn't know it was there. Simple enough. I decide to cut the 2 a citation for simple possession, but since I took them to the PD their car was towed and they had to pay a $65 tow bill. On the tow sheet I wrote that the car needed to be picked up by the mother of the boy as it was in her name too. This is kinda like a teacher making a student take a note home to be signed and returned in a way.

I talked to the boys later and they were students at the Community College where I went to the Academy. Both really decent kids just being stupid. I didn't detect them being high at the time either.

Goes to court and the lawyer helping me out with my seperation approaches me and ask if we can plea the case. I am leery at first, but ask for one stipulation. That the boys submit to a random urinalisys at my choosing for up to one year at their expense, not to exceed 2 times in a month. The lawyer and the boys agree and the case is dropped unless they violate the guidelines set by the judge per my request.

So in a sense they were not charged criminally, but rather by me and what I felt was right. It isn't always like that, but am glad as it is a win-win deal for all involved. I get them to submit within 12 hours of request and they get it off their record.

Thats great that you handled it that way.Seems there are times when decent kids try things and get caught and don't really realize at the time what kind of an impact it can have on them for most of there lives.Good for you and I'm sure it was a lesson well learned by them and i hope for there sakes they stay out of trouble!
Hats off to you for making sure there was a punishment without ruining there lives with something like what could have been on there record!

Dadgummit Tim where were you when I needed you in 1977.

I have a Class C misdemeanor for the same thing that still haunts me to this very day.

Whenever I have had a pre-employment background check run on me its always the same old song and dance................"You have a drug conviction on your record".

For Christ's sake it was 30 years ago with no repeat offenses(because I have'nt touched anything stronger than an aspirin since).

Tim,
You did well my friend. My hope is the boys learn from what happened, and I believe they will. Years from now they'll be damn glad you let them off since they don't seem like the type to do drugs.
Plus, they will learn what being accountable means.

I have had some experience with the same situation.
I was run off the road by a car while in my semi near where I lived. This kid did try it again 3 times before I got to my parking spot.
He was driving a Pinto wagon, Had enough beer cans in the back end to build a volkswagon.

I called the cops and my friend SGt Peters arrived.
To make a long story short , We went to court. This kid drove a tow truck for a living.

He was drunk at time of arrest and was very beligerant and sloppy.

The judge and the Lawyer argued and I stated my side of the situation as how it took place.
The judge made a decision. He was to pay a fine, got to jail for 30 days,( suspended sentance so he could work) and was to be on probation for 5 years.

I ask to speak, Judge said ok.

I asked , if he does not go to jail not get into any trouble with in the 5 years, , I mean any kind of trouble that requires a citation or legal court procedings that this action today be removed from his record. I don't want something he does today as a young man to prevent him from getting a better job such as with the Govt or in some security area.

Judge agreed, He thanked me for doing it and the kids Dad was thankful for it. The young man turned around looked me in the eye and said FucX you mister.

Of courses the Judge was none too happy. Not only got the original sentance but got 6 months +the 30 days jail time to be served NOW and a $500 dollar fine.. profanity , contempt of court, something about disrespect and you know how some of that legal stuff goes.
Judge was not happy, nor was the kids father.

One case where you try to help and it is wasted effort.

The judge would have had to remind my Dad to use a little restraint in public, after he had backhanded me and I had landed on the other side of the courtroom if I had made that comment to you.

Seems to me, the lack of that style of parenting is a basic cause for what seems to be far too many young people like that ungrateful little a**hole.

Most of the time I would agree with this, but sometimes you just have a bad seed and no matter what they just won't learn no matter what a parent does nor does not do.
