received a call from a distressed O/O. Seems he leased his truck to a carrier, felt he was being shorted, and ended the lease. Unfortunately his driver and the carrier he is leased to aren’t cooperating.
The carrier is he leased to is paying his driver .30 a mile and is not paying the O/O for his truck.
This is NOT a safety issue.
The O/O was advised to draft a letter, have it notarized along with the certified mailing documents, and mail the letter to the carrier. If the O/O has not heard back from the carrier after the 30th day of the carrier receiving the certified mail the O/O should call the FBI.
Yes, the FBI. This is interstate theft and the FBI is equipped to handle and has the jurisdiction to handle the case.
Local police will be of little assistance. The O/O lives in California, the carrier is based in Illinois, the last time the O/O spoke with the driver he was in Mississippi headed for Los Angeles.
According to the O/O he has not been paid since December 2005.

Eight months + without getting paid for his truck???????? Who is paying for the fuel and maint???

Here's another piece of advice if anyone's interested. Yest I spent all day in DFW getting parts for my end dump, air/hoist for the latches on the tailgate, a tarp, tires, metal for welding, plus had to apply for another license plate............have over $1100. out of pocket expenses so far, all because of the jackass that I rented my trailer to stole all this stuff off it, plus had to have someone go over 150 miles to get it where he FINALLY told me it'd be. (didn't even have the balls to bring it back, even if somewhere in town here) I have a signed lease agreement, his DL# plus expiration date, his SS#, DOB, but no physical address, just a P O box #, so there's nowhere to serve him papers. I'd never get any money reimberssed, but at least I tried. GET A PHYSICAL ADDRESS ON WHO YOU DO BUSINESS WITH!!!, whether it's trucking or anything else. I'm not done trying to nail this guy, but a physical address sure would help. The address on his DL is over a yr and half old. Am gonna talk to a local cop, who's trailer park addy jackass is still using, and explain it all to him and see if he can help. Wish me luck....................I need it. Victims have no rights.

You would be better off to write this one off as a lesson in life and don't let it happen to you again. You will spend way over $1100 chasing this guy and you would be better off working towards something more productive and profitable.
If you can prove a crime was commited, you can get the DA to chase this guy for you and that next traffic stop he has, he will be arrested! Make absolutely sure it was a crime and not a civil matter because a lawsuit for false arrest could be very very costly to you.
