			<content:encoded><![CDATA[<blockquote class="blogcontent restore">First Observer Program: Protecting Our Country By Sandy Long  Terrorism, whether domestic as in the bombing of the Murrah Building in Oklahoma City, or foreign as the World Trade Center bombings were, can affect us in many ways. After the Murrah Building bombing, security was intensified around federal and state government buildings and people were appalled that Americans could do such an act. After 9/11, fear entered our lives as security increased, racism increased against middle-eastern people and the economy started to crumble. Officials started looking closer to our national security, how important trucking was to everyone and how easily the movement of goods could be interrupted to bring the country to a stop. Realizing that truckers are everywhere in this country and are observant of their surroundings, the Transportation Security Administration initialized a program called the Highway Watch Program in conjunction with the ATA. Problems occurred along with bad publicity as some states required drivers to join the program to renew or obtain their CDLs. The Transportation Security Administration withdrew its funding from the program and revamped the program into the First Observer Program. Under a contract funded by the Department of Homeland Security and the Federal Emergency Management Agency, HMS Company, “a professional services firm, experienced in providing valued-added program management, operational, and information technical services within the public safety, homeland defense, and emergency management sector” is the team leader and organizer of the program.  Uniting with OOIDA who has over 160,000 members comprised of company truck drivers and small business truckers and the Teamster’s Union with over one million members who work in all aspects of transportation and construction provides a broad range of applicants to the program; both organizations provide training and outreach to their members. Other partners in the program are Total Security Services International Inc. and Patton Boggs LLP The First Observer Program trains professional drivers to look for suspicious activity on the road, along infrastructures like bridges and in the actions of other motorists. Utilizing a call center where calls from participants are cleared through one central location then passed on to appropriate authorities; drivers no longer have to rely on finding the appropriate officials thru the 911 systems. Besides truck drivers, commercial bus drivers, construction workers and any along the supply chain are encouraged to participate. Training consists of watching a series of videos in the appropriate module for the observer’s profession. These videos address how to watch for suspicious activity, how to protect loads especially hazmat, and how to assess and report suspicious activities. September 11, 2009, webinars were offered for the first time to train drivers. My question is this: Anyone out there heard of freight brokering school called Freight Broker School out of AZ. The expert is David G. Dwinell. He states drivers can make .50 per mile more if he is a trucker broker. Has anyone else heard about this person? Does anyone have any commemts? <br />

His wife took over the phone and started talking about that scam artist that just was arrested for scamming those Wall Street investors. Her take was that he was an evil man. Though I agreed with her that he was a criminal, I also told her that people had to take some responsibility for losing their money too. Of course, this led to a heated debate with her giving the phone back to my brother. We are in a terrible financial and personal countrywide mess. Too many of us got houses we could not afford, too expensive of vehicles and lived way beyond our means. While times were good, or seemed to be because everyone was building a house of cards…literally, people became blind to the chipping away of our rights by the government that is supposed to work for us. Along with this apathy to government, more and more people looked to the government to solve every little ill they had and did not, nor have now, thought to take any responsibility for where they are. People, who invest their whole life savings in something that seems too good to be true, find that most times it is not true and this is exactly what happened with this scammer. Now they are screaming, some even wanting the government to refund their investments beyond what the securities insurance allows. Is it any wonder? I haul auto parts…the big plants have acres upon acres of cars and light trucks sitting waiting for someone to buy them while car dealerships are glutted and no one can afford new cars…yet, they are still turning out new cars and trucks every few minutes. More of the ‘if we build it, they will buy’ mentality…. I see more and more warehouses being built, while there are hundreds of new warehouses sitting empty with for sale or lease signs on them… Same goes for houses…yes, they are still building some…why I do not know…no one can afford $150,000 houses now, if ever they could…. I see more malls being built while malls that were huge a few years ago are empty… Why is there such a waste of materials and effort being spent now when we are in a terrible economic mess? Why are our politicians adding billions of dollars of earmarks to a budget that is only money without backing and that puts us further in debt? Why is the US sending money and aid to fight drug cartels in Mexico? Why is the EPA so strong that they are dictating laws? Why is NAFTA not being weakened if not broken? Why are oil companies still not paying royalties for drilling on our soil? Etc, etc, etc, Who is to blame for all the mess this country is in…look in the mirror. In the heated debate with my sister in law, she said someone should do something. When I told her to sit down and write her congressmen and senators and asked did she vote for incumbents or new people, she replied, “Why, it doesn’t do any good.” It was my disagreeing with her on that, which put her off the phone. We have allowed this country to get into this mess by being apathetic sheep that are following the Judas goat of our government and taking this country off the cliff. We are the ones who got greedy, wanted to live above our means, who concentrated on religion instead of good government, who blindly followed one party or the other without thinking beyond the R or D behind someone’s name. We sat back and let these people in DC get way out of hand and totally away from the Constitution that set the laws in place so that what we have now could not happen. People want now to sit back and wring their hands and look to the government to bail us out…well, DUH!!!…they are the ones that we allowed to get us here in the first place…just like that Madoff or whatever that scammer dude’s name is…they are taking us to the cleaners and we are letting them…now we look to them for solutions???? Take a good look in the mirror…realize that the power to effect change is in your hands. Write a letter or email…hell, write a hundred of them…make phone calls daily to YOUR representatives…tell them to straighten up and start listening to WE THE PEOPLE and take care of us first…or you will fire them come next election…or start a campaign in your state to impeach them…it is our right under the constitution at least for now. Then take another look in the mirror…and accept responsibility for your part in this mess and see the spark of fire in your eye now that you are taking steps to correct your mistakes in judgment. The faces in all of our mirrors created these problems…the faces in our mirrors can solve them.</blockquote>

</div>It is a sad state of affairs when the well-being of an animal is taken more seriously than the well-being of a human. Alas, this is what is happening in the trucking industry throughout the country as more and more anti idling regulations are being passed and as companies limit idling in their attempts to increase their bottom lines. Citing fuel costs, almost all companies are requiring their drivers not to idle the trucks except in extreme temperatures if at all while most are not providing APUs to make sure their drivers can sleep safely and comfortably. States are passing anti idling laws saying that trucks are polluting the air by idling while a driver is taking their mandated breaks. A person can get a ticket for leaving a dog in a not running car even with the windows down, where does concern for the health and safety of the driver come in.<br />
There is a big push on about driver’s health and their driving safely with sleep apnea being determined to cause driver fatigue. No one has addressed not idling as contributing to driver fatigue. Almost all anti idling laws have some sort of rule that allows a driver to idle their truck for 5-10 minutes an hour during their required breaks to cool or heat the sleeper. Think about it. A driver cools their truck down enough to go to sleep initially. Then when they get too cold or hot to sleep, they have to get up, turn on the truck and sit there hoping that in the time allowed, the truck either warms up enough to produce heat or cools the cab down enough to be able to return to sleep. They then have to turn off the truck again only to repeat this routine repeatedly throughout the break time.<br />
FMCSA HOS regulations require, “CMV drivers using the sleeper berth provision must take at least 8 consecutive hours in the sleeper berth, plus 2 consecutive hours either in the sleeper berth, off duty, or any combination of the two.” Consecutive means all at once, not interrupted every hour or so for 10 minutes to get up to heat or cool the truck down.<br />
The body regulates temperature through a process known as thermoregulation, which is the ability of an organism to keep its body temperature within certain boundaries, even when temperature surrounding it is very different. Too low of a body temperature results in hypothermia which is dangerously low body temperature, below 95F; too high of a body temperature results in hyperthermia which is dangerously high body temperature 102F+.<br />
There are no studies done about truckers and the extremes in temperature they will have to endure when not being able to idle their trucks. I did however find studies on extreme temperatures from the military, fire departments and OSHA among others. From Firehouse.com: “From a medical perspective…even when outside temperatures are fairly tolerable (a temperature of 90 degrees Fahrenheit, for example), the interior temperature of a closed vehicle can rapidly become lethal (over 135F) in a very few minutes.” <br />
OSHA has identified the effects of extreme temperatures on workers. “The effects of hypothermia and hyperthermia are, loss of concentration and difficulty focusing on a task for hyperthermia, for hypothermia: loss of ability to do complex motor functions, lethargy and mild confusion. (Moreover, those are just the first signs of it!) Hypothermia can occur not only in freezing temperatures but also is common among the elderly who live in cold houses,” says OSHA. What about a driver in a cold truck, Can the effects on the human body be safe for truckers to chance?<br />
To put a face on those who are suffering from the in justice of the laws and policies about idling, Laurie, a rookie woman driver who has been driving for just 3 months, was told by her company that she could not idle her truck for any reason no matter what the temperature or she would be fired. She runs the West Coast and the Rocky Mountains where temperatures can range from below zero in the mountains to well above 100 degrees in the California deserts. When Laurie requested to be assigned a truck with an APU unit installed, which the company has some of, she was told that she had <i>not earned </i>it yet. Laurie has few options due to her lack of experience other than comply.<br />
Another rookie driver died last year in a truck stop because of his employer putting a gas run generator in the cab of the truck where the jump seat had been removed where it could not be stolen, so the driver could run a fan while trying to sleep instead of idling. Though the generator was vented out the side window, it was not adequate to keep carbon monoxide out of the cab and sleeper berth. <br />
Not only rookie drivers are being affected. I was employed for 21 months by a trucking company where I was one of the top three rated drivers in the company for 2007. By the end of the first quarter of 2008, I stood in great jeopardy of being fired due to my idle times not meeting company guidelines even though I was still in the top tier of drivers. I have to idle the truck while sleeping due to health reasons, but the company did not care. I chose to quit before being fired. Even with my career record, it was difficult to find a company with reasonable idling policies.<br />
Fatigue and driving safety are not the only factors not being taken into consideration by the ‘powers that be’ that set anti idling laws and policies. A driver’s personal safety is also grossly affected. Trucks and truckers have always had a bull’s eye on them marking them as targets for robbery, hijackings and other crimes against a person. A driver who has to leave windows and vents open for ventilation is setting themselves and their equipment up as easy marks for criminals. Not only does it allow devices to be used easier to unlock doors, but for over the 30+ years I have been driving, I have heard of many instances where criminal shoots ether into cabs of trucks to sedate the driver so they can be raped, robbed or the truck and load stolen.<br />
The public does not understand the damage the anti idling laws can do to a trucker, they do not think about us as people affected adversely. A woman at a plant where I was loading overheard me talking about Laurie’s plight and asked what I was talking about. She said, “Trucks cause pollution so shouldn‘t idle.” When I explained it, she was appalled that people would be forced to try to sleep in those conditions. She understood better, when I asked her if she would try to sleep in her car in 70+/- degree weather with just her windows down. She said, “No, she would not be able to sleep due to the temperatures!” When I asked her if she would consider sleeping in the parking lot of the plant or in her driveway at home in her car with her windows cracked or down to stay cool at night, she exclaimed, “heck no...It would not be safe!” Thank you ma‘am...my points exactly.</blockquote>

Copyright Sandy Long</div>In my old age, I often think that if I would of known when I was young that I was going to live this long, I would of taken better care of myself. I have added another regular thought; if I would of known that the economy was going to tank, freight was going to go so soft for so long and I was going to end up job scared, I would of saved more money and done things differently years ago. Sad part is that I am actually better off than most are. Many people have to re-evaluate their financial status; too many have been bit by the buy on credit bug. Some are losing their homes and many have lost their businesses. How do you rebuild from ground zero or below?<br />
In no way am I a financial adviser, so I cannot tell you to invest in anything, but I have started over several times in my life so can speak from experience at the very least. The main thing is to get back to work if you are jobless, find any job you can, two if you have to. I have done everything from washing dishes in a greasy spoon to cleaning houses to keep body and soul together, sometimes working three jobs a day. Did I like it? Not really, but I was not asking for handouts and could at least walk tall.<br />
If you are a trucker and have lost your job, check out getting into anything energy related. From what I am hearing, OD loads of windmill parts are going to boom after the first of the year and already are running fairly strong. The oil fields are starting to open up too. The OD loads need escorts, no not those kind; car escorts. I was offered a job recently doing escorting for a company that is getting into OD hauling of windmills. Reefer freight is usually good too specially if you haul meat. Chemicals are still moving fairly well, as is fuel.<br />
Then you have to get back to basics. What are the basics? Same as when you first left home when you turned 18; food, shelter and clothing, though hopefully, you have retained your clothes no matter how bad it has gotten. A car might be necessary to get back and forth to work and the grocery store. We are talking basics though. One does not need to eat prime rib, live in a 5000 sq ft house when it is only you and your spouse, nor drive a Jaguar. One really has to rein in their champagne tastes to fit their beer budgets.<br />
By now most likely, your credit report is in shreds anyway, so cut up the plastic, let the bank have the too big house and let the fancy car go back. Rent a reasonably priced house or apartment, buy a cheap car, clip coupons and buy generic. Sit down and realistically look at what you make a week and a month and budget it out. Every week put the rent, grocery, utility money aside, then divide the rest up among health care, insurance etc and do not forget a small percentage to go into savings. If you have anything left, take the family to the park for a homemade picnic, it is cheaper than McD’s.<br />
You have to think hard some times to figure out how to survive without plastic cards to pay for everything you want. The litmus test is to say to yourself, ‘do I need this or want this.’ If you need it, figure out how badly you need it or would a cheaper item or one you already have work for a while. If you only ‘want’ something, it is not going anywhere, put it back on the shelf and go home. Think about it for a day or two and count your money. I usually find that by the second day of ‘thinking’ about it, I have forgotten that I wanted it in the first place.<br />
Starting over and digging your way out of a financial hole is tough and some of the things that I suggest are perhaps hard to deal with. Giving up a dream house or car that you bought thinking that times were going to stay good can really become depressing and knowing that the credit that you have worked so hard to build up over the years is down the drain makes it worse. <br />
Taking the negatives that are happening and turning them into positives will work towards healing not only the depression, but also will rebuild your self-esteem as you dig out. Remember, that you started out one time with nothing and built it up to something; you can do it again. Only this time, learn from your digging out to do it on your own without all the credit used to buy the ‘I want’ things instead of using cash to buy what you need; the basics.<br />

You see, I pull a flour tanker (dry bulk, pneumatic). The mill that I usually run from loads those tanks through a &quot;stinger&quot; pipe at the rear of the trailer. The flour gets pumped into the tank under pressure, resulting in the load filling the front of the tank first. The mill hasn't got one of the newer style over-head bins to drop the load in through a hatch on top of the trailer.  (which takes much less time: 20 minutes versus two hours through the stinger).<br />
<br />
A normal load for me is 50,000 pounds, +/- a few hundred, giving me a gross weight around 77,000 pounds (yes that's right, my empty weight is usually around 26,500-27,000). With over half the load filling the front third of the trailer... well, you can see there's a high probability of trouble with axle weights being poorly balanced.<br />
<br />
Most times the folks at the mill who pre-load trailers also ensure there's at least 32,000 on the trailer axles (there's a scale on site). When the load is fresh, it's a simple matter of backing up and hitting the brakes to move the flour backwards and level the load inside the trailer.<br />
<br />
This particular day my axle-weight air gauge was frozen, the scale at the mill was in use by farmers bringing in wheat, and I was pressed for time. I jumped in and drove, figuring the weights  to be okay as they usually are.<br />
<br />
The South Dakota port of entry on I-90 westbound thought otherwise.<br />
<br />
$179.00 and two hours later, I cross the scale one more time and get the green light. My destination in Sioux Falls is only 15 minutes away.<br />
<br />
At least it doesn't count as a moving violation on my record. But it still pizzez me off... it's the first ticket I've had in over ten years.</blockquote>

The good: Not to sound like an advertisement, but vBulletin is professional grade.<br />
<br />
The bad: The change-over has not gone over well with the masses. The vast majority of complaints sound something like this: <br />

But just look at all the neat STUFF -like this user's blog, created in just a few short minutes- that TSUSA members have at their finger tips. The doorway to all this goodness is simply opening the &quot;UserCP&quot; (user's control panel) and browsing through the various options. <br />

Go ahead, click it. I won't mind a bit if you don't read any more of this blog entry.<br />
